This Privacy Policy describes how Curve Collective, plus-clothing-co.myshopify.com (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

Device information

Order information

• Examples of Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number.
• Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
• Source of collection: collected from you.
• Disclosure for a business purpose: shared with our processor Shopify.

Children's Data

The Site is not intended to be used by children, and we do not knowingly collect any personal information about children under the age of 16. If you are the parent or guardian of a child who has provided us with their personal information, please contact us to request that it be deleted. 

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

Lawful Basis

Retention

Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

• Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
• Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

Your rights

The UK Data Protection Act 2018 provides rights for individuals:

• The right to be informed encompasses our obligation to provide ‘fair processing information’, typically through a privacy notice. It emphasises the need for transparency over how we use personal data.
• The right of access- individuals have the right to access their personal data and supplementary information. The right of access allows individuals to be aware of and verify the lawfulness of the processing.
• The right to rectification- your personal data can be rectified if it is inaccurate or incomplete
• The right to erasure is also known as ‘the right to be forgotten’. The broad principle underpinning this right is to enable an individual to request the deletion or removal of personal data where there is no compelling reason for its continued processing for example upon the withdrawal of consent for direct marketing.
• The right to restrict processing- individuals have a right to ‘block’ or suppress processing of personal data.
• The right to data portability allows individuals to obtain and reuse their personal data for their own purposes across different services
• The right to object to processing based on legitimate interests or the performance of a task in the public interest/exercise of official authority (including profiling); direct marketing (including profiling); and processing for purposes of scientific/historical research and statistics
• Rights in relation to automated decision making and profiling. The DPA provides safeguards for individuals against the risk that a potentially damaging decision is taken without human intervention.
• The right to withdraw consent at any time, where relevant. We are required to make it as easy to withdraw consent as to give consent.
• The right to lodge a complaint with a supervisory authority. If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Your Personal Information will be initially processed in the United Kingdom Ireland and then will be transferred to Europe for storage and further processing, including to Canada and the United States. Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. International Transfers
